Orders and Payments
To make the purchase, follow the online procedure carefully. The Brand Sponks reserves the right to refuse or cancel an order, in case of doubts on the truthfulness – incomplete or incongruent personal data, default of payment already manifested in previous purchases, doubtful credit card authenticity – or in case of unavailability of products.
The communication of refusal of the order (by e-mail or telephone) may not be timely and may also take place as a result of subsequent contact by the customer.
How to buy
1. Click on the desired product to access the relevant product sheet and view all the relevant information on the product in detail. Select the quantity and the possible size, then click on “Add to cart”.
2. Enter the information needed for shipping and select the payment method:
• credit card / PayPal (for Italy and abroad).
Finally, read the summary of your purchase and click on “Buy”.
At the end of the purchase, you will receive an e-mail containing the identification data of your order and confirmation that it has been correctly received.
The execution of orders is allowed only for adults.
Sponks will not be held responsible for orders placed by minors without parental permission.
Prices and payment methods:
The prices shown on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment charges are in any case communicated in advance to the Customer through the site or these Conditions.
THE FOLLOWING METHOD OF PAYMENT IS PROVIDED:
Credit card / PayPal
Credit card, the transaction can be done through the safe server chosen by Sponks. In this case, the payment will be made to the customer’s credit card. No data will be kept responsible for any fraudulent and undue use of credit cards by third parties upon payment. For all credit card payments, there are secure PayPal circuits, but you do not need to have an account already. If you already have it, you can pay through your PayPal account.
PAYMENT SECURITY:
The payment transaction takes place on a protected page, which uses SSL (Secure Socket Layer) certificates, a system that guarantees maximum security for online transactions. Credit card data is guaranteed by unauthorized access through the encrypted transfer of SSL data, not accessible to third parties.

According to the 13th article of Legislative Decree n.196 / 2003 “Code for protection of personal data”, here is some information related to the collection of personal data online. The data responsible is the Sponks brand, which provides for the processing of personal data in full compliance with Legislative Decree no. 196/2003. DATA TREATMENT
Personal data are collected for contractual, administrative-accounting, commercial purposes and for the establishment of normal business contacts. Their treatment is manual and computerized. The data will be communicated to shippers, as well as for marketing, advertising, promotional and market research initiatives. In Sponks, the personal data has been communicated to the personnel of the Marketing Administration, as subjects responsible and in charge of the treatment.
RIGHTS OF THE CUSTOMER
According to 7th article of Legislative Decree no. 196/2003, the subjects to whom the personal data are addressed can at any time obtain:

– verification of accuracy

Returns and Refunds
According to 52nd article of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer must send to Brand Sponks a notice to that effect, within the terms indicated, to the following email address info@sponks.com. You will receive an e-mail with the authorization for the purpose and the correct procedure to be completed (courier, etc.)
In case of withdrawal, the Customer must send the products to our warehouses, within 14 (fourteen) days from the same withdrawal, to the following address:

The right of withdrawal will be possibile, in compliance with the following conditions:
– It is not possible to withdraw only on a part of the purchased product (accessories, etc …);
– in order for the withdrawal to be possible, the product must be intact and returned in its original packaging, complete with all its parts (labels, tags, labels, seals, etc …);
– the shipment indicated by Brand Sponks, is under the full responsibility of the customer;
– in respect of the control, the product will be made available to the Customer, canceling the request for withdrawal;
– Brand Sponks will not be responsible in any way for damage, theft, loss during or due to return shipment.
Brand Sponks will refund the customer the full amount already paid, net of any additional shipping costs according to art. 56, paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days of withdrawal, through the purchase procedure of the amount charged, unless otherwise agreed. In any case, the cost has never been exceeded if the standard procedure has not been used.
In any case, the Customer will lose the right of withdrawal in the cases in which Brand Sponks ascertains that:
– the returned product and / or its accessories, and / or its packaging are not intact;
– the product is missing its external packaging and / or the original internal packaging;
– the product is missing elements integrating the same and / or accessories (eg Ex. closures, laces, buckles, etc.).
– the product is missing the disposable seal
In the case of the right of withdrawal, Brand Sponks will return to the product, adding shipping costs and the price of the product.
Shipments
Products are shipped by courier.
A tracking service is active for this shipper.
The courier service deliveries from Monday to Friday, both in the morning and in the afternoon. The council can not request delivery in specific days or times. In absence of the recipient, the courier will leave with notice of passage, through a label attached. Will be attempted to contact the recipient. The Sponks brand below “Sponks” will not be responsible for any malfunction in the service delivery by the courier.
Sponks will not be held responsible for non-delivery of the package to the final order.
Customer is required to check:
or the number of packages delivered to what shown in the transport document;
or that the packaging is intact, not damaged, or wet or otherwise altered, also in the closing materials (adhesive tape or metal straps).
Any damage to the packaging and / or the product or the mismatch in the number of letters, were immediately detected, with a specific indication of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received are reported within 14 days of delivery.
SHIPPING COSTS
The cost depends on the country of destination and the weight of the package. Before the end of the order, before confirming.
SHIPPING TIMES
The delivery of products takes place within 24-72 hours, after 24-48 days from the order registration. Possible delays in delivery from the case of force majeure in case of holidays. In case of purchase, the delay in shipping can be taken from the impossibility in taking the amount authorized to pay. (See: Debit payment). The delivery times indicated are indicative and a delay with respect to them, or the possible delivery with the subsequent fractioned shipments do not legitimize the customer at the time of delivery and the request for compensation or compensation.

General Conditions of Sale
ART. 1 – ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT
The contract between Sponks and the Customer (the individual, the physical person) must be considered with the acceptance, even partial, order from Sponks. In case of non-acceptance of the order, Sponks will provide in any case timely communication to the Customer.
These conditions can be saved, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
ART. 2 – PURCHASE METHODS
The products offered for sale are totally from the site di sponks.com, and they’re like the descriptions provided in the relevant information sheets.
In any case, it remains a product that is not perfectly representative of its characteristics but could differs, for ex. for color and size (also in terms of browsers and monitors for accessing the site and displaying images).
After the conditions have been fulfilled, they are the characteristics of the product and / or products that you intend to purchase. The customer must also request to Sponks, where desired, the issue of a tax invoice related to the purchase, pursuant to art. 22 D.p.R. n. 633/1972.
The confirmation of the order arrives by e-mail from Sponks to the Customer. This message summarizes the purchase conditions, both in terms of the use of the law.
ART. 3 – PRICES AND PAYMENT METHODS

ART. 4 – DELIVERY OF PRODUCTS AND RELATIVE COSTS
Within 24-72 hours, after 24-48 hours from the registration date of the Order by Sponks at the cost indicated on the Site before sending the Order. Sponks reserves the right to accept or not deliveries requested outside the Italian or European borders.
The delivery times indicated are indicative and a delay with respect to them, or the possible delivery with the subsequent fractioned shipments do not legitimize the customer at the time of delivery and the request for compensation or compensation.

ART. 5 – RIGHT OF WITHDRAWAL

This is a part of normal diligence, without any signs of wear or dirt, in compliance with the following conditions:
– the right of withdrawal that applies to the product purchased in its entirety; in fact it is not possible to withdraw only on part of the purchased product (accessories, etc …);
– in order for the withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (labels, tags, seals, etc …);
– the shipment, up to the certificate of receipt in the warehouse indicated by Sponks, is under the complete responsibility of the customer;
– in case of damage to the transport, with regard to time, the product will then be made available to the Customer, canceling the request for withdrawal;
– Sponks will not respond in any way to damage, theft, loss occurred during or in any case depending on the return shipment.
Sponks will refund the customer the full amount already paid net of any additional shipping costs pursuant to 56th article, paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days of withdrawal, through the purchase procedure of the amount charged, unless otherwise agreed. In any case, the refund is not provided if the return does not come from Italy. Sponks is suspended until the return of the returned product or when the Customer proves to have respected the product, if previous.
In any case, the Customer will lose the right of withdrawal in the cases in which Sponks ascertains that:
the returned product and / or its accessories, and / or its packaging are not intact;

In case of forfeiture of the right of withdrawal, Sponks will return it to the purchased product, adding shipping costs and, if already reimbursed, the price of the product.
ART. 6 – GUARANTEES
All products sold by Sponks are covered by a guarantee of 24 (twenty-four) months for conformity defects, pursuant to Title III of Legislative Decree no. 206/2005. To use the warranty, the customer must keep the invoice, or the receipt of payment, together with the transport document.
The warranty for defects of conformity will apply as long as the relative product has been used correctly, respecting its intended use and as provided in the instructions for use and washing present in and / or with the product.
In the event that, for any reason, Sponks is unable to provide the Customer with a product under warranty (restored or replaced), or where the repair or replacement were, also because of the value of the product, excessively burdensome. Sponks can proceed to the appropriate reduction of the price paid, ie the return of the full amount paid with termination of the contract.
In cases where the application of the guarantees provides for the return of the product, the same must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

ART. 8 – PRIVACY
The personal data collected with the forwarding of the Order will be processed by Sponks for the sole purpose of meeting the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Customer.
ART. 9 – APPLICABLE LAW
The contract of sale referred to in these Conditions and its execution and regulated by Italian law, with the disregard of the conflict rules. For the settlement of the relative disputes the Court of the municipality of residence of the Brand Sponks will have jurisdiction.
ART. 10 – COPYRIGHT
Trademarks, logos and other distinctive signs on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs is prohibited, including reproduction on other websites by unauthorized third parties. The contents of the site are protected by copyright (texts, images and graphics).
ART. 11 – AGREEMENT
The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the object of the contract, together with the order, the general conditions relating to the use of the site and the relative conditions to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.
ART. 12 – COMMUNICATIONS
All communications between the parties must be made in writing and sent to the address of the other party indicated in the contract and in the order. The communications sent to the e-mail address, indicated on the website and in the order, are also sent in writing.
Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgment of receipt.
